Terms of Service

Efiewura provides an online platform that helps users discover, advertise, and communicate about property listings (rental, sale, short stays, and similar). We are not a broker, estate agent, landlord, tenant, insurer, or financial adviser. We do not own, manage, or verify every listing. Users deal directly with each other unless we explicitly state otherwise. Any transaction, lease, or contract is between you and the counterparty; Efiewura is not a party to that contract except where we separately offer a specific paid product governed by additional terms.

You must be at least 18 years old (or the age of majority where you live) and capable of entering a binding agreement. You must provide accurate registration information and keep it updated. You are responsible for safeguarding credentials and for all activity under your account. Notify us immediately of unauthorised use at support@efiewura.app.

Hosts and organisations are responsible for the accuracy, legality, and completeness of listings (including photos, videos, pricing, availability, fees, taxes, permits, and descriptions). You must have rights to submit all content you upload. You must not post misleading, discriminatory, defamatory, infringing, unsafe, or illegal content, or use the Services for scams, spam, or circumvention of fees.

You grant Efiewura a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (e.g. formatting), display, distribute, and promote your content as reasonably necessary to operate, improve, and market the Services — including in search results, maps, social previews, and partner surfaces. You retain ownership of your content subject to this licence.

• Comply with applicable laws, including fair housing, consumer protection, anti-discrimination, and data-protection rules.
• Do not harass, threaten, stalk, or harm other users; do not discriminate unlawfully in offering or seeking housing.
• Do not scrape, overload, reverse engineer, or attempt to bypass security, rate limits, or access controls.
• Do not introduce malware, intercept communications, or misuse another user’s data.
• Do not use the Services to launder money, evade sanctions, or facilitate illegal activity.

Tools for messaging, scheduling, or inspections are provided for convenience. Users are responsible for confirming identity, property condition, documentation, and safety. Meet in safe locations; follow local guidance. Efiewura does not guarantee attendance, outcomes, or suitability of any property or counterparty.

Certain features may involve payments, deposits, wallet balances, subscriptions, promotions, or third-party processors (e.g. Paystack). Additional terms, fees, and taxes may apply. You authorise us and our partners to charge payment methods you provide according to the product flow. Refunds and chargebacks are handled per applicable policies, processor rules, and law. We may change pricing with reasonable notice where required.

The Services, branding, software, and Efiewura content (excluding user-generated content) are owned by Efiewura or its licensors. Except for the limited rights granted in these Terms, no rights are transferred. Feedback you provide may be used without obligation to you.

The Services may link to or integrate third-party sites, maps, analytics, identity tools, or payment providers. Their terms and privacy policies govern those services. Efiewura is not responsible for third-party content or practices.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT LISTINGS ARE ACCURATE, COMPLETE, LEGAL, OR AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFIWURA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS — EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EFIWURA FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED GHANA CEDI (GHS 100), IF NO FEES WERE PAID. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED BY LAW.

You will defend, indemnify, and hold harmless Efiewura and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, your listings, your violation of these Terms, or your violation of third-party rights or law.

We may suspend or terminate access to the Services, remove content, or restrict features at any time for breach of these Terms, risk, legal requirements, or operational reasons. You may stop using the Services at any time. Provisions that by nature should survive (e.g. licences granted as needed to operate archival copies, liability limits, indemnity, governing law) will survive termination.

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict of law principles, unless mandatory consumer protections in your country require otherwise. Courts in Ghana shall have non-exclusive jurisdiction, subject to any rights you may have to bring claims in your place of residence where applicable law requires.

Before filing a claim, you agree to contact us at support@efiewura.app to attempt informal resolution.

We may modify these Terms. We will post the updated Terms and update the "Last updated" date. Material changes may require additional notice. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, stop using the Services.

• Entire agreement: These Terms, together with our Privacy Policy and any product-specific terms you accept, constitute the entire agreement regarding the Services.
• Severability: If a provision is unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• No waiver: Failure to enforce a provision is not a waiver.
• Force majeure: We are not liable for delays or failures due to events beyond reasonable control.
